Part 20 of the Constitution, in Article 368 of the Constitution amendment process has been mentioned.
संविधान के भाग -20 के Article 368 में भारतीय संविधान संशोधन से संबंधित प्रक्रिया का उल्लेख किया गया है।
भारतीय संविधान में संशोधन की तीन पद्धतियां हैं -(There are three methods to amend the Constitution)
(1) साधारण बहुमत द्वारा (by a simple majority)
(2) विशेष बहुमत द्वारा (by a special majority)
(3)विशेष बहुमत तथा राज्यों का अनुसमर्थन(The special majority and ratified states.)
साधारण बहुमत द्वारा (by a simple majority)
भारतीय संविधान में कतिपय अंश ऐसे हैं जिनको संसद केवल साधारण बहुमत से परिवर्तित कर सकती है। ऐसे उपबंध निम्नलिखित हैं –
(1) Article 2, 3 and 4, the Parliament points out that by law the right to insert the new states, boundary changes could create new states can make changes in the schedule and accordingly the first and fourth.
Article 2, 3 और 4 जो संसद को कानून द्वारा यह अधिकार दिलाते हैं कि वह नए राज्यों को प्रविष्ट कर सके, सीमा परिवर्तन द्वारा नए राज्यों का निर्माण कर सकें और तदनुसार प्रथम एवं चतुर्थ अनुसूची में परिवर्तन कर सकें।
2 Article 73(2) जो संसद की किसी अन्य व्यवस्था के होने तक राज्य में कुछ सुनिश्चित शक्तियां निहित करता है।
3 Article 100(3) जिसमें संसद की नई व्यवस्था के होने तक संसदीय गणपूर्ति का प्रावधान है।
4 Article 75, 97, 125, 148, 165(5) तथा 221(2) जो द्वितीय अनुसूची में परिवर्तन की अनुमति देते है।
5 Article 105(3) संसद द्वारा परिभाषित किए जाने पर संसदीय विशेषाधिकारों की व्यवस्था करता है।
Article 106 जो संसद द्वारा पारित किए जाने पर संसद सदस्यों के वेतन एवं भत्तों की व्यवस्था करता है।
Article 118(2) जो संसद के दोनों सदनों द्वारा स्वीकृत किए जाने पर प्रक्रिया से संबंधित विधि की व्यवस्था करता है।
Article 120(3) जो संसद द्वारा किसी नयी व्यवस्था के न किए जाने पर 15 वर्षो के उपरान्त अंग्रेजी को संसदीय भाषा के रूप में छोडने की व्यवस्था करता है।
Article 124(1) जिसमें यह व्यवस्था है कि संसद द्वारा किसी व्यवस्था के न होने तक उच्चतम न्यायालय में सात न्यायाधीश होंगे।
Article 133(3) जो संसद द्वारा नई व्यवस्था न किए जाने तक उच्च न्यायालय के एक न्यायाधीश के द्वारा उच्चतम न्यायालय को भेजी गई अपील को रोकता है।
Article 135 जो संसद द्वारा किसी अन्य व्यवस्था को न किए जाने तक उच्चतम न्यायालय के लिए एक सुनिश्चित अधिकार खेत्र नियत करता है।
Article 169(1) जो कुछ शर्तो के साथ विधान परिषदों को भंग करने की व्यवस्था करता है।
विशेष बहुमत द्वारा (By special majority)
Most of the provisions amending the Constitution requires a special majority in Parliament. Special or specific majority of the membership of the House means that a simple majority of the 2/3 majority of the members present and voting, participating. भारतीय संविधान के अधिकांश उपबन्धों में संशोधन के समय संसद में विशेष बहुमत की आवश्यकता होती है। विशेष या विशिष्ट बहुमत से तात्पर्य यह है कि सदन की कुल सदस्य संख्या का साधारण बहुमत तथा उपस्थित और मतदान में भाग लेने वाले सदस्यों का 2/3 बहुमत। विशेष बहुमत की आवश्यता भारतीय संसद के दोनों सदनों में होती है।
भारतीय संविधान में विशेष बहुमत और राज्यों का अनुसमर्थन (The majority of states in the Indian Constitution and ratification)
There are some provisions of the Constitution, to which the amendment of the special majority of the Houses of the Indian Parliament with grains – at least half the states require the approval of the Legislature. The following topics are related –

भारतीय संविधान में संयुक्त बैठक का प्रावधान नहीं (Joint Meeting of the provision in the Indian Constitution)

Article 368 के अधीन रहते हुए भारतीय संविधान संशोधन विधेयक उसी प्रक्रिया के पारित किए जाते हैं। किन्तु यदि भारतीय संविधान संशोधन विधेयक पर दोनों भारतीय सदनों में विरोध है तो गतिरोध दुर करने हेतु भारतीय संविधान में संयूक्त बैठक का कोई प्रावधान नहीं है।
भारतीय संविधान में राष्ट्रपति संशोधन विधेयक पर अनुमति देने के लिए बाध्य है (Constitution Amendment Bill on the President is obliged to allow)

Article 111 के अनुसार जब साधारण विधेयक राष्ट्रपति की अनुमति के लिए भेजे जाते हैं तो वह अनुमति न देकर उसे सदनों को पुनर्विचार करने के लिए लौटा सकता है किन्तु Article 368 के अन्तर्गत राष्ट्रपति भारतीय संविधान संशोधन विधेयक पर अनुमति देने के लिए बाध्य है। न ही विधेयक प्रस्तुत करने से पूर्व राष्ट्रपति की पूर्वानुमति की आवश्यकता है।
